Firms Wins Motion for Summary Judgment Defending Homeowner from Bank Deficiency
Wilenchik and Bartness won a motion for summary judgment defending a homeowner from the bank's claim to a $350,000 deficiency after his home was foreclosed on. Wilenchik and Bartness argued that the Mueller ruling, which was handed down by the Court of Appeals a week before argument, precluded the action. The Judge ruled from the bench in the homeowner's favor.
