Wilenchik and Bartness Prevails in Quiet Title Actions

Dennis Wilenchik and Brian Hembd obtained dismissal of a quiet title action in which the Plaintiffs sought title to a property valued at over $3,000,000. The firm succeeded in getting the complaint dismissed on the grounds that the Plaintiffs never had any actual interest in title to the property and were merely investors who loaned money to another lender who actually held an interest in title.Dennis Wilenchik and Jack Wilenchik obtained summary judgment in a quiet title action concerning 17 acres of property that is in the midst of development. Plaintiffs claimed that a five-year-old deed in the chain of title was forged or otherwise ineffective and sought to undo five years in the chain of title. Summary judgment was awarded to the Defendants on the grounds that there was no evidence that the deed was forged or ineffective and that the Defendants were also bona fide purchasers for value without notice.
